About the EB-2-NIW
The EB-2 National Interest Waiver lets advanced-degree professionals (or those with exceptional ability) skip the PERM labor-certification process and self-petition when their work has substantial merit and national importance.
Eligibility is governed by the Matter of Dhanasar three-prong test. You must show: (1) your proposed endeavor has substantial merit and national importance; (2) you are well positioned to advance it; and (3) on balance, it benefits the U.S. to waive the job-offer requirement.
Unlike EB-1A, NIW does not require sustained acclaim. It rewards clear articulation of your endeavor, evidence of your trajectory, and a credible argument for why the U.S. benefits when the labor-certification gate is removed for someone like you.

Good to know
- NIW requires you to define a specific endeavor — not just a job. Vague descriptions are the most common reason for RFEs.
- National importance is not the same as national scale. Local or sector-specific work can qualify if its implications are national.
- You can hold NIW and pursue EB-1A in parallel; many candidates do.
